The owner of a lot shall be responsible and accountable for the actions of all lawful occupiers of the lot and any licencees or invitees having access to the lot;
The owner of a lot must take all reasonable steps to ensure that they, their occupiers, licencees and invitees abide by these by-laws and do not behave in a manner likely to interfere with the peaceful enjoyment of a person lawfully on another lot or common property;
The owner of a lot will be liable to compensate the body corporate for any damage to the common property caused by its occupiers, licensees or invitees;
The owner of a lot must pay the whole of the body corporate’s legal costs (solicitor/client) incurred in recovering contributions and other moneys owing by the owner to the body corporate which sum shall be deemed to be and shall be a liquidated debt owing to the body corporate.
The occupier of a lot must not without the body corporate’s written approval cause the lot to be used for any purpose other than as a residence;
The lot must not be used for any illegal, unlawful or immoral purpose or for any purpose which would likely interfere with the peaceful enjoyment of a person lawfully on another lot or common property.
Except as provided in these by-laws the occupier of a lot must not without the body corporate’s written approval make any change to the external appearance or structurally modify the lot;
An occupier may not without the body corporate’s written approval display any sign, advertisement, banner, pamphlet or like matter on any part of his lot in such a way as to be visible from another lot, the common property or outside the Scheme Land;
An occupier may install a locking or safety device to protect the lot against intruders, a screen to prevent entry of insects or animals provided however that any device or screen so installed shall be soundly built and consistent with the colour, style and materials of the structure;
Any modification provided for by these by-laws or approved by the body corporate shall be maintained and kept in good repair by the occupier of the lot;
The occupier shall not hang curtains or window coverings visible from outside the lot unless they are consistent with the colour, style and materials of the structure and which have received the written approval of the body corporate;
The occupier shall not without the consent of the body corporate in writing hang washing, bedding or other articles (except on clothes lines provided for the purpose of hanging laundry) in such a way as to be visible from another lot, the common property or outside the Scheme Land.
a. An occupier must not without the body corporate’s written approval make any changes or modifications to or in any way damage or deface a structure which forms part of the common property;
b. An occupier must not damage a common property lawn, garden, tree, shrub, plant flower or growing thing;
c. An occupier must not without the body corporate’s written approval use any portion of the common property as a garden.
An occupier must not obstruct lawful use of the common property by any other person.
An occupier must not cause a nuisance or act in any way so as to interfere with the peaceful enjoyment of a person lawfully on another lot or using the common property.
An occupier must not create any noise likely to interfere with the peaceful enjoyment of a person lawfully on another lot or using the common property;
Occupiers, licencees and invitees leaving or returning to lots late at night or early in the morning must do so with minimum noise;
In the event of unavoidable noise, the occupier so affected must take all practical means to minimise its effect upon other persons.
Subject to Section 143 of the Act an occupier must not without the body corporate’s written approval keep, bring or permit an animal or bird on the lot or the common property;
Any consent of the body corporate may be given on conditions and may be withdrawn at any time.
An occupier shall not waste water and shall insure that all water taps on his lot are promptly turned off after use.
The occupier of a lot must not without the body corporate’s written approval park a vehicle or allow a vehicle to be parked or stand on the common property;
The body corporate may cancel any approval under this by-law by giving seven (7) days’ written notice to the occupier.
Unless the body corporate provides some other way of garbage disposal an occupier shall keep an adequately covered, clean and dry receptacle for garbage on the lot or common property designated by the body corporate;
An occupier must comply with all local government laws about disposal of garbage and ensure that in disposing of garbage it does not adversely affect the health, hygiene or comfort of occupiers of other lots;
An occupier must not keep, deposit or throw upon the lot or common property any rubbish, dirt, dust or other material likely to interfere with the peaceful enjoyment of a person lawfully on another lot or the common property.
An occupier shall not do or keep anything in or on the property which shall affect the rate of insurance premiums on Scheme Land or which may conflict with any insurance policy upon the Scheme Land.
The occupier shall not without the body corporate’s written approval store a flammable, dangerous or noxious substance on the common property;
The occupier shall not store or use a flammable, dangerous or noxious substance on the lot except in such quantities or amounts as can be justified for domestic use;
The occupier shall not use any chemicals, burning fuels, oils, acetylene gas or alcohol on his lot or in any way cause or increase a risk of fire or explosion on the lot;
This section does not apply to the storage of fuel in the fuel tank of a vehicle, boat or internal combustion engine or a tank for the storage of such fuel that is stored according to the requirements of law regulating the storage of flammable liquids.
